PAYMENT of RESERVATION PACKAGE and LOCAL FEES· Payments must be made in U.S. Funds with a valid credit card or banking account. · All rates are based on a single Booking and are subject to North Carolina sales tax of 6.5% (subject to change as government agencies update).· Entry into the venue will not be permitted without full payment of any outstanding balance due on the reservation invoice. · $100 Cleaning Fee included in each Booking under the reservation· Reservation made greater than thirty (30) days before the Booked event date:· $500 nonrefundable deposit to secure date is required and deposit will be applied to total amount due· 100% of the remaining total reservation amount shall be paid within 30 days of the Check-In date.· Reservation made within thirty (30) days before the event / Booking:100% of the reservation balance shall be paid CANCELLATION:· Cancellations made greater than thirty (30) days before the event Booking date: Guest will receive a 100% refund of the total reservation amount, minus a deposit fee of $500.· Cancellations made within thirty (14) days before the Booking event date:Guest will receive a 50% refund of the total reservation amount.· No-shows, will be charged the full amount of the reservation (i.e. no refund).· As part of your reservation, we hold the venue space you reserve. In return, you agree to pay for the quoted rate for the number of hours reserved. We understand that plans change, but as a small, local establishment with limited availability, cancellations affect us significantly. As your circumstances are totally out of our control, we cannot assume all of the risks for cancellations; and, therefore, we must enforce the cancellation policy without exception.
SMOKING, CANDLES, ETC.: There is NO SMOKING permitted inside the venue or anywhere on the property by GUEST(s) or anyone else that the GUEST(s) permits on the property. Guests may smoke in their vehicles or on the gravel driveway. Additionally, there is no open flame, burning of candles/scents/incense/oils, charcoal, etc., nor use of lighters or other household appliances permitted within the venue or anywhere on the property other than what is already provided within the venue spaces (for example, flameless candles). This is due to sometimes extremely dry conditions outdoors and ridgetop winds. Sparklers will be provided by the venue and lit only on outside solid surfaces during the Couple's Farewell.
USE OF UNIT, FEATURES AND AMENITIES: We strive to provide a complete representation of the description and pictures of the venue and its features and amenities. Be advised that your Booking rate includes use of the venue configuration, features, and amenities, and shared/common areas identified under the terms of this agreement, is accepted "as-is", and in no way creates rights to alter, re-arrange the unit or its amenities, nor to access other areas not specified as venue space.• SHARED AREAS: Certain areas of the property are shared or common areas with owners on the property (such as parking areas, walkways, exterior stairs, etc.).• RESTRICTED AREAS: GUEST(s) shall not access or use areas not described in their booking, including but not limited to: a) areas, access-ways, or amenities of the property which may belong to or are a part of another private space;) under no circumstances should any guest enter the access-way area into the electric/water/ utilities room (this is for the safety of guests and for the protection of mechanical equipment located below the level 1 access-way); and/or, c) areas which may be locked or designated as 'private', 'no entry', or 'private use only'.• PRIVATE ENJOYMENT OF OTHER VENUE AREAS: COUPLE and any of your guests will respect the privacy and bounds of owners , venue features and amenities, venue access-ways, and the privacy of those individuals who occupy them.
MAINTENANCE of SYSTEMS and FACILITIES - We strive to ensure that all facilities are in good repair and everything is in working order. It is expected that major systems in and around the rental unit will break down from time to time such as air conditioning, appliances, etc. The COUPLE shall provide notice to the Venue Coordinator of leaking faucets, hoses, running toilets, problems with appliances, other maintenance which may be required, or which may impact the next scheduled COUPLE use of the premises as soon as the problem occurs. All reasonable attempts will be made to repair the problem as soon as possible upon notice by the COUPLE. We assume no liability to COUPLE; if such should occur as all products have a useful life and break down occasionally. Additionally, there shall be no liability to COUPLE for electrical or internet/WiFi outages beyond our control. We cannot control electrical outages or internet quality or speed; therefore, there will be no refunds due to interruptions or speed. We will keep you informed if we get information that an outage is expected to last an extended period of time, however, it is usually resolved in a few hours.
NATURAL EVENTS and DIASTERS: In the event of an impending or past natural storm, disaster, or other occurrence (example: including, but not limited to, hurricane, earthquake, tsunami, etc.) where the local government or whether authority advises travelers, tourists, hotel or guest house occupants, and/or non-residents to evacuate the area and/or seek shelter in a location identified within the local territory, Guest(s) must comply and vacate the rental property and not return until the territory has deemed it safe to do so. In the event Guest(s) refuses any part of the foregoing: 1) host/property manager is not responsible for the safety or loss to Guest(s) or their property; 2) host/property manager is not responsible for finding Guest(s) alternate arrangements for accommodations or any related costs; and, Guest(s) will be responsible for a daily/nightly rate of stay of $500/night for each day/night they remain at the rental property effective as of the same date such local advisory goes into effect.
PERSONAL SAFETY and SECURITY: Lock car doors and windows of your vehicle. Property owners are not responsible for lost or stolen items.
INTENDED USE AS A WEDDING / ELOPEMENT VENUE RENTAL: Any occupancy will be in the form of a wedding/elopement only and not constitute a permanent or primary residence or other tenancy or landlord-tenant relationship. Assignment, subletting and/or rental arbitrage by any party except the host/property manager is not allowed. Any form of occupancy found to be adverse to the intended or permitted use shall be subject to forfeiture of all amounts paid, and the party will not be permitted to check in, upon discovery GUEST(s) and their guest(s) will immediately vacate the premises upon demand, may result in eviction from the premises without notice, and/or may result in incurring additional charges. GUEST(s) agree to be responsible for any and all fees incurred by host/property management. Such form of adverse occupancy may also include, but shall not be limited to: tenancy; social events or unauthorized gatherings or organizing; club meetings; bachelor or bachelorette parties; other unauthorized parties; corporate events; political assembly; activist assembly; religious assembly; protests; or any sales or trade, legal or otherwise.
FALSIFIED RESERVATIONS - Any reservation obtained under false pretense shall cause this Agreement to terminate and will be subject to forfeiture of all amounts paid, and the party will not be permitted to check in, upon discovery will immediately vacate the premises upon demand, and/or may result in eviction from the premises without notice. Falsified reservations may include, but not be limited to, the Number of GUESTs, ages, names, assignment, subletting or arbitrage, and use of property for any other use other than as a vacation rental.
SAFETY, ASSUMPTION OF RISK, and INDEMNIFICATION - By accepting this Agreement, GUEST(s) acknowledges and agrees that the: accept terms and conditions within the listing description and are voluntarily participating in use of the property, accommodations, and facilities of the premises; hereby assume all risk of any harm, injury, accident, illness, damage or loss to person and property arising from their reservation or use of the premises; and, are responsible for the safety of themselves, their children, their guests and/or their guests' children, and any third party providing a product or service to GUEST(s) (for example: chef, massage therapist, photographer) while on or about the premises. GUEST(s) expressly agrees to release, indemnify, defend and hold harmless hosts/managers/owners of the property, their agents, officers, staff, affiliates, associates, agents, employees, assigns, successors, transferees, and licensees and their respective parent and subsidiary companies, officers, directors, shareholders, members, officers, and employees from and against any and all losses to person and property, damages, liabilities, injuries, accidents, illnesses, claims, suits, cause of action, losses, costs and expenses, including legal fees and expenses, for personal injury or property damage or loss sustained by GUEST(s) and GUEST(s)' invitees arising out of use or occupancy of the premises. The hosts/managers/owners are not responsible for direct, indirect, incidental, special or consequential damages, acts, events or omissions occurring in, on or about the premises, or arising out of or in any way related to GUEST(s) use or occupancy of the property, GUEST's breach of any term of this Agreement, or related to a breach of any obligation, warranty, representation, covenant set forth herein, or any work, activity or thing done, permitted or suffered, including third-party materials, products, or services made available through the site. GUEST(s) expressly agrees to release, waive, discharge and covenant not to sue hosts/managers/owners of the property, their agents, officers, staff, affiliates, associates, agents, employees, assigns, successors, transferees, and licensees and their respective parent and subsidiary companies, members, officers, directors, shareholders, officers, and employees from and against any and all losses to person and property, damages, liabilities, injuries, accidents, illnesses, claims, suits, cause of action, losses, costs and expenses, including legal fees and expenses, including death, that may be sustained by GUEST(s) or GUEST(s)' invitees, or to any property belonging to GUEST(s) or GUEST(s)' invitees arising out of use or occupancy of the property. For example: walkways, driveways/parking, sidewalks, stairs, decks, railing, flooring, ingress and egress, pool/hot tub areas, etc. may be slippery if wet; caution should be exercised near or when approaching deck railings; appliances and water coming from faucets may be hot. This list is not all-inclusive but indicates some of the hazards that may be found, so it is advised to use caution inside and outside of the venue space at all times. GUEST agrees that anyone else that the GUEST(s) permits on the property to abide by the rules at all times while on the property. Please be sure to secure your personal belongings, both in the venue space and personal vehicle. Venue Coordinator/owner/property manager not responsible for lost or stolen items. Guest(s) shall be self-informed of any impending weather events and/or travel requirements into or out of the territory (for example: health risks such as COVID-19, Natural Events as described herein, etc.), as well as their risks.
TERMINATION: Something Blue Mountain Venue reserves the right, at its discretion, to terminate, without notice, an individual's reservation where deemed necessary through unacceptable behavior or as a result of actions which are likely to endanger or offend others. In such circumstances, any outstanding account must be settled, and no refunds will be made.
WRITTEN EXCEPTIONS - Any exceptions to terms of this agreement must be approved in writing in advance. Failure of manager/owner to enforce any provision of this Agreement will not be deemed a waiver of any other provision or continuing waiver.
LAW - This agreement shall be governed by the laws of the state of North Carolina and the United States of America. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in North Carolina as applicable, for any matter arising out of or relating to this Agreement.
ENTIRE AGREEMENT - Reservation is not considered confirmed without acceptance of these terms and conditions. These terms and conditions, together with the Reservation Invoice, shall constitute the entire agreement (the "Agreement") between the parties. If for any reason any portion of this Agreement is unenforceable, that portion shall not affect the applicability or validity of any other portion of this Agreement. This Agreement and any modifications, including photocopies or facsimiles or electronic signature, may be signed in one or more counterparts, each of which will be deemed an original and all of which taken together will constitute one and the same instrument. If there is more than one GUEST, all GUESTs or intended GUESTs are jointly and severally liable under this Agreement. In the event of a conflict among the terms of the various parts of this Agreement and any previous offer, discussion between the parties, etc., the terms and conditions of this Agreement shall prevail.
I, or we, the GUEST(s), hereby certify and consent as of the date of the reservation booking that I/we have read the entire listing, agree to the terms and conditions, and will comply with them during the course of the vacation rental.
